Conférencier : M. Jean-Luc Quinio est, depuis septembre 2005, conseiller juridique à l’ambassade de France en Chine. Magistrat de l’ordre judiciaire, il a successivement occupé des fonctions juridictionnelles, d’inspecteur des services judiciaires et de conseiller au cabinet du garde des sceaux, ministre de la justice, avant d’être chargé de la création du poste de conseiller juridique à Pékin.
Présentation : En Chine, le droit et la justice sont en pleine mutation. M. Jean-Luc Quinio a accepté, dans le cadre du cycle des conférences « La Chine et son Droit » de nous faire part de ses réflexions sur cette évolution, sur la réalité du système judiciaire chinois et sur les perspectives d’évolution qui se manifestent. La conférence laissera une large place au dialogue avec le public – que celui-ci soit spécialisé ou non- et à des échanges autour de réflexions plus générales sur la place du droit dans la société chinoise. Cette conférence aura lieu en français.

Title: China and its Tax Law: Recent Controversies and Issues at Stake
Presentation : As the wealthy and the upper-middle-class in China gain greater voice in the media and the political process, tax issues now appear in public discussions more frequently than ever. Reform of the personal income tax and the introduction of a new property tax are two recent examples. The talk presents both the law and the economics in these two areas of policy, and shows how there is a wide gap between the way tax policymakers consider them and the way they are discussed in the press. As background, a primer about the central and local government’s respective roles in China’s tax system is offered.

CUI Wei is an Associate Professor at the China University of Political Science and Law in Beijing. He was a recent consultant to the Budgetary Affairs Commission of the National People’s Congress and the Tax Policy Division of the Ministry of Finance (MOF) on VAT legislation, and to the MOF and State Administration of Taxation in drafting income tax rules for corporate reorganizations and foreign tax credits. In addition, he currently serves as Senior Tax Counsel to the China Investment Corporation, overseeing the tax aspects of CIC's overseas investments. Wei Cui received his B.A. from Harvard College, M.A. (philosophy) from Tufts University, J.D. from Yale Law School, and LL.M. (tax) from New York University Law School.

Studies in Intellectual Property and the Chinese legal systemFranklin Pierce Law Center leads in intellectual property education in the United States . The China Intellectual Property Summer Institute at Tsinghua University School of Law, Beijing which started in 2002, is a natural extension of the Intellectual Property Summer Institute which has been held at Pierce Law every summer since 1987. Tsinghua University, the premier institution of science and technology in China, established its School of Law in 1999 in a new facility at the center of the Tsinghua campus in northwest Beijing, the site of the former Imperial Gardens of the Qing dynasty princes. Università degli Studi di Milano, Faculty of Law was established upon the University of Milan ’s foundation in 1924. The Faculty features an extensive array of teaching options and fields of research, including many specialized disciplines that are designed to support the more traditional ones. Recognizing the important role Europe plays in the progressive development and codification of international intellectual property law, the new established cooperation among Franklin Pierce Law Center, Tsinghua University School of Law and Università degli Studi di Milano, Faculty of Law will facilitate the development of sound principles of international legal education. Who Should Attend The Pierce Law-Tsinghua Univeristy-University of Milan study abroad attracts law students (both JD and LLM), and practicing attorneys from the United States and a number of foreign jurisdictions. The curriculum is designed to introduce major themes and issues in intellectual property law and practice in China and their relationships to international trade, and to provide a deeper understanding of the dynamic changes taking place in China 's information economy.
