To foster research in law and economics, the Foundation supports the research program on "The principle of full reparation for harm done in tort law", carried out by Mr. Philippe Pierre, Professor at the University of Rennes 1.
In the context of a French tort law reform currently being prepared, the goal of this program is to analyze the "pros and cons" of French-style full reparation.
The very principle of full reparation has been
continuously challenged. This network of researchers
therefore seeks to analyze, by using a comparative approach, the reality of how
the principle of full reparation is applied.
To that end, a questionnaire has been sent to university professors and legal
practitioners in Europe and Latin America.
Using information from the questionnaires, the comparative law study was complemented by an empirical, quantitative study illustrating costs and their foreseeability with respect to implementing tort liability within the framework of a civil law legal system.
Within the scope of this program, the Foundation also supports the organization of the following seminars:
- In 2008, in Rennes, on "The principle of full reparation in tort law”.
- In 2010, in Saint Malo, on "Reparation for harm done".
- In 2011, in Paris, on "French tort law faced with European harmonization projects".
