Presentation

The Chair’s objective is to promote the continental legal culture, by the development of cooperation between  Colombian jurists and  French jurists.

This cooperation, headquartered at the Externado University in Colombia, is developing, not only in  the academic environments, but also expanding in the direction of legal and judicial environments and business circles, in order to create a forum for common thinking and action.

Yves Marie Laithier

Second conference: Contract Law and Economics, by Mr. Yves-Marie Laithier, Professor at the University of Reims

-First, that French contract law is geared toward the creditor's ability to actually recover his debt, a political orientation which is not only founded on a moral precept (honoring one's word) but is also justified from an economic point of view

- Second, that French law provides the creditor with tools aimed at attaining this goal, some of which, although efficient (in the economic sense of the word), do not exist in common law (for example, the penalty clause).

Third conference:  Corporate Law and Economics, by Mr. Philippe Dupichot, Professor at the University Paris II, Panthéon-Assas

This course reflects on the following questions. The function of a company is to provide market players with a structure with enables concentration of capital. This power of concentration is expressed through a collective will at the general shareholders meeting or through the will of their representatives. This rule common to all companies takes on special characteristics for listed companies and for unlisted targets for private equity.

Fourth conference:  Law on Securities, Insolvency Proceedings and Economics, by Mr. Michel Germain, Professor at the University Paris II, Panthéon-Assas
This course aims to test the hypothesis of a dependence by the French law on Securities and Insolvency Proceedings on economic considerations and, if so, to measure the level of this dependence.
